1. Services

SystemTwo provides growth-marketing strategy and execution, including Growth Blueprint, GrowthOS Guided and Embedded, S2 Recruitment, and S2 Capital. The scope, deliverables, and fees for any paid engagement are set out in a separate written Engagement Agreement. If these Terms conflict with an Engagement Agreement, the Engagement Agreement governs for that engagement.

2. Eligibility and accounts

The site is intended for businesses. Access to any SystemTwo client portal is limited to authorised clients and their approved users. You are responsible for keeping account access details secure and for activity under your account.

3. Acceptable use

You must not use the site, any client portal, or SystemTwo materials for unlawful, harmful, misleading, abusive, infringing, or security-compromising activity. You must not attempt to disrupt, reverse engineer, scrape, overload, or gain unauthorised access to any part of the site, client portal, or related systems.

4. Proposals, fees and payment

Fees are those stated in the Engagement Agreement or, where applicable, the published pricing. Prices shown on the site are indicative and may change. Payment, billing, renewals, and refunds are governed by the Engagement Agreement. Payments are not processed through the site.

5. Client responsibilities

Clients are responsible for providing accurate information, timely access, approvals, feedback, assets, and cooperation needed for SystemTwo to perform the agreed services. Clients are also responsible for ensuring that their own marketing, data, product, and commercial decisions comply with applicable laws and internal requirements.

6. Intellectual property

The site, its content, brand, copy, designs, frameworks, and materials are owned by SystemTwo or its licensors and may not be copied or reused without permission. Ownership of deliverables created in a paid engagement is governed by the Engagement Agreement.

7. Confidentiality

Each party may receive confidential information from the other. Confidential information must be used only for the relevant relationship or engagement and must be protected with reasonable care. Confidentiality obligations in an Engagement Agreement apply to paid engagements.

8. Third-party services and links

The site and services may reference or connect with third-party websites, tools, platforms, or service providers. SystemTwo is not responsible for third-party content, terms, availability, security, or practices. Your use of third-party services may be subject to their own terms.

9. Disclaimers

The site is provided as is and as available. SystemTwo does not guarantee that the site will be uninterrupted, error-free, or free from harmful components. SystemTwo does not guarantee any specific business, marketing, revenue, hiring, investment, or performance result.

10. Limitation of liability

Any liability arising from a paid engagement is limited as set out in the Engagement Agreement. To the extent permitted by law, SystemTwo is not liable for indirect, incidental, consequential, special, punitive, or loss-of-profit damages arising from use of the site. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law.

11. Termination

SystemTwo may suspend or terminate access to the site, any client portal, or related materials if you breach these Terms, misuse access, or create security, legal, or operational risk. Termination of a paid engagement is governed by the Engagement Agreement.

12. Governing law

These Terms are governed by the laws of Switzerland. The courts of Zürich, Switzerland have jurisdiction, subject to any mandatory legal rights that cannot be varied by agreement.

13. Changes to these terms

SystemTwo may update these Terms from time to time. When we do, we will revise the effective date shown on this page. Continued use of the site after an update means you accept the updated Terms.
